Good evening and welcome to Hawkesbury City Council meeting of the 8th of September 2026. I'd like to welcome those who are attending the meeting in the gallery tonight, as well as those that may be attending online. Hawkesbury City Council acknowledges the Darug and Dharugung people as the traditional custodians of the land of the Hawkesbury. We pay respect to Elders past, present and emerging, and acknowledge all Aboriginal and Torres Strait Islander people as First People of this country. General Manager.

So these are the working groups that have come off the Heritage Advisory Committee, and so far I've just gone on them as chair. The other option is that it needs to be one of the five councillors who are on the Heritage Committee, or I don't think it will make sense. Councillor Djuric and I have previously been on the Windsor Bridge Artefacts Working Group, and I think that that membership carried over under the terms of reference. Sorry, I've just kicked my fancy Hawkesbury mug under the table. So it may be that this is something that's easier for the five councillors to just sort out. And

The Outer Western Sydney Alliance, which is for the Mayor, and I have just been discussing with Councillor Sheather who we may attend together for a passover for a little while to transition out of that, so we'll both go to that for a short while. Yeah, they're currently going through a transition with the old sort of structure of the organisation and some mergers, so they're going to hopefully come and brief the General Manager and the mayor.

So thank you to everyone serving on those committees and those joining, and for the work done if you're stepping down. Is there anything else we need to discuss with this matter before we move on? Wheeler. Thanks, Madam Mayor. Look, one of the issues I think that we have with this committee, with the committees, is the lack of formal reporting mechanism. I've discussed it with people on a few other councils, and they tend to just set up a semi-formal reporting structure, and perhaps we can do that now. We can't have briefings, so perhaps in some of those council sessions, people who are on particularly external committees where the minutes don't come back to councils, or where the minutes are more complex, like the ARIC, it might be helpful if we have some time set aside each month for some of that committee information to come back to us, rather than us trying to— It's one of those unknown unknowns, I think.

You know, you don't know, or unknown unknowns. You don't know what to ask because you don't know what's going on in those spaces. So where Heritage comes back in a fairly sort of clear-cut... Lengthy minutes, as does floodplain. Some of the other stuff is much harder to work out what's going on. So if we could, if the staff could incorporate some formal discussion mechanism, that would be helpful. Given that it doesn't come back to the Chamber, the Minister should be entirely happy with that.

One in particular is the impact of the developer, or the construction company, Bathla, going into liquidation, which I understand has some impact on the vineyard contributions. Could we get some details of that? I'm happy to take that on notice, but I think it would be helpful if we had some public feedback on what's likely to happen there. Could we also get some information on the two grants that we've received, the Permit, Plug and Play and the Safer Cities, if councillors could receive some information about what's intended to be done with those grants. Another question. How long do we have funding built in for the community hubs?

Thank you. Through you, Madam Mayor, we'll take the first two questions on notice. In terms of the community hubs, the grant body has extended the time to acquit the funding until June 2027 , and we've currently extended the officer doing that position until the end of November.

Through you, Madam Mayor , we have the capacity to extend the officer because there will be grant funding left and we're still within the time frame. And in addition to that, we are undertaking a review to look at the future of that position. Great

It would be good if we could discuss that as part of the budget preparations as well, the continuation of those community hubs for next year's budget. Could we also have a workshop on our parks, including information about play facilities and resourcing So some information. I know we had to remove some play equipment and we've had some downgrading of some spaces as a result. Could we have a workshop or discussion on where we are with the condition of our parks and the play facilities in them, again, so that we can think about resourcing before budget discussions? There's just some, and the other thing I'd like, two other things I'd like some information on is the future options, the future investigation into the animal shelter, if we could get some info on that, and a discussion about where we are with FOGO and what's happening with that project, please.

And then I'll just make some general points about the report. There's some really good and interesting projects in this report. It's another good example of the activities that Council is undertaking that you probably wouldn't know about if you didn't delve into the content of the report, if you just skimmed over the bits in the business paper. But some really useful stuff like the Learn to Drive supervisor workshops for parents of kids who are learning to drive, and a couple of workshops for kids themselves learning to drive. I remember attending something similar when my son was at that stage that was run by Blue Datto, and really getting a lot of information out of that and finding it quite useful at changing my thinking around some of the things to do with teaching a young person to drive.

The tree mapping project is nice to see evolving. I can see that we're up to another bin audit, which I'm sure will upset everybody when they get the wrong sticker on their bin. And I do want to celebrate the fact that we only have four ICE vehicles left in the fleet, something I didn't think we would achieve in my lifetime, let alone in my time on Council.

And I think it would be useful if people got that information ahead of the newspaper getting hold of it. My only concern with this report, this is, I think this is a really helpful and useful process , and it's very well detailed, but my only concern with it is that we seem to be missing a step at five in the framework where risk is reported to Council. So I can see what's supposed to be reported, and there's a line about the General Manager discussing the active plan with the governing body each term, but I think it falls a little bit short, particularly in a high-risk environment, and I think it would be helpful for— For councillors to be told if something is of high risk, that we need to be involved or be cognisant of the management of, and I don't think we can do that on a once-a-term basis.

So I'd actually quite like—I'm happy with one and two in the resolution, but I would like 2. 2 in the recommendation that we rework the risk management plan to increase reporting to Council. So I'll move that as an amendment if the initial mover prefers that.

Through you, Madam Mayor, for any risks that reach the threshold outlined in the plan, or the policy, I should say, for any specific projects or individual projects, that would go up through the governance framework that we already have in process, which is incorporated into but sits outside of the strategic risk register. With respect to strategic risks that escalate, that would, I think, first go to ARIC and be reported on a regular basis to ARIC. But we can certainly take on board the— and review the policy, sorry, the plan, insofar as ensuring there's an adequate step in there to satisfy Council that it is reported to Council in a timely fashion.

Thank you. Yeah, I noticed that things got to ARIC, but they seem to stop at the ARIC, and they don't come back to us. And it's that missing loop back to the governing body that I find concerning. So I get that the ARIC is, you know, a relatively recent development that is supposed to protect us from ourselves, but I find it problematic that as a governing body, we don't get adequate feedback from ARIC, and we are therefore not as aware of what's going on in that space. And I think that's been exacerbated with the loss of briefings where we would have something come to us that we discussed, and I would therefore prefer to see a formal arrangement where heightened risk comes back, and maybe it's flagged in the ARIC report for Council to deal with, if that's the better mechanism.

But I'm not satisfied with where we sit now. I don't think that it gives the governing body enough information for us to meet our statutory requirements. Can

We that being the case, however, if we're about to adopt it, we'd probably need to have something in there to reflect what you've just said. If you want to add something or request that something be added. So

Could point two be that the risk management plan include a reporting mechanism to Council post-ARIC for risks that escalate or are likely to escalate ? Does that consist with the general manager's advice earlier?

Yes. Yeah . Yeah. Through, Madam Mayor, if I could offer some slightly amended wording that the risks be, so strategic risks be reported or flagged on the production of the minutes from ARIC, where a risk sits outside Council's tolerance.

I was actually going to ask a question of, could we just have an explanation about how the Audit, Risk and Improvement Committee, now I'm the delegate, how that fits into the earlier discussions we were having about , you know, how delegates can provide a list of Council those sorts of kind of meaningful bits of information that come out of the Audit and Risk Committee. So I think the General Manager, excuse me, has nailed it. It's just going to be the exceptions because there's so many risks that we would be drowning in risks. So it's sort of, I think I could probably take on that process of trying to figure out what is an exception.

On page four of the plan, I was quite satisfied with the relationship that it has under 2.3, which is the risk governance, because it has a very clear connection between Council and the Audit Risk Committee. The other connections to the General Manager and the Director of Corporate Services are not so strong, apparently. So, you know, I think we've got a plan that's okay to adopt at the moment. I think, yeah, I mean, I'm happy to support the extra points, but I think that's how I read that, and I had the same sort of, you know, questions as Councillor Wheeler. So, yeah, that will be. A good idea, but I think it needs to develop, to develop. So don't possibly, you know, hold us to account just yet, because I think this is going to have to, yeah , be useful and not overbearing.

Why these are very detailed in relation to the risk to Council, one of the things that concerned me, and might be ably explained by the General Manager, is when we look at the risk to Council, that it doesn't detract, I guess, from outside organisations or individuals that may have business with Council. Just how might that be addressed? So we say we need to lock ourselves in a room. It's just that no one might be able to get in. Can that be explained? General

Through you, Madam Mayor, it's a little bit difficult to, I guess, discuss this in the hypothetical, and I note that the risk strategic risk register is a confidential attachment. What I can offer is that through the review and the development, the risks, the way that the risks are assessed are against the risk of Council or events leading to Council not being able to deliver on its strategic objectives. So that considers— The, for example, the ongoing ability to deliver services and engage with the community, for example, and it has to strike that balance between those two competing demands that I think you're alluding to. But to go into any further detailed discussion, I suggest that we would have to move into confidential.

Thank you. I think we need to put on record what's going wrong, frankly, with the Local Government Grants Commission and their distribution of the financial assistance grants. If you look at a comparison of what the Hawkesbury receives per capita compared with our neighbours in the Blue Mountains, or even Wollondilly, who we are frequently compared with, or Wingecarribee, who we also often compare ourselves with, the disparity is pretty clear. Hawkesbury gets $39.83 under the New South Wales Local Government Grants Commission. Blue Mountains gets $121.07 per capita. So that leaves us with $5.1 million and Blue Mountains with $11.5 million. The Central Coast gets in excess of $33 million. Wingecarribee gets $70 per person compared to our $39 per person.

So what we see is $5.1 million and falling, and then falling further in real terms due to inflation. I note that Hunters Hill and Mosman, with their tiny LGAs and tiny populations, I think Mosman has something like nine square kilometres in its LGA and two major roads, so they've got about six streets that they're required to maintain. They're receiving an increase of 6%. We're getting a reduction of 4%. What we receive under the financial assistance grants, the whopping $5.1 million, barely covers what we pay out in EPA levy back to the state government, $4.5 million. This disparity in financial support from the federal government via the New South Wales Local Government Grants Commission leaves us open to targets from the community because it requires us to raise rates to cover the obvious shortfall that we constantly run.

So what I would like us to do is request the member for Hawkesbury, Robyn Preston, who has gone on public record chastising us for the recent SRV, request that she makes representations on our behalf about the stark disparity between the Blue Mountains per capita allocation of $121 relative to the Hawkesbury's allocation of $39.83, and also to contact the member for Macquarie, Susan Templeman, and make her aware of the disparity in allocation across her electorate, including the reduction in funding available to Hawkesbury City Council. Given that this is federal money, these are federal assistance grants to council, both our representatives, state and federal, need to be aware of what's going on in this space and hopefully make some representation to have this allocated in a fairer scheme.

The scheme that we have clearly isn't working when this council doesn't receive an uplift because of how disaster-prone we are, because of the very large responsibility we have for roads maintenance across the LGA. When the formula doesn't make any allowance for that, it's clearly broken. When an LGA that has a similar disaster profile, or in fact a lesser disaster profile, given that it doesn't flood, and yet receives three times what we receive per capita in the Blue Mountains, clearly something is very wrong with the formula, and our residents are suffering as a result.

Firstly, through you to Councillor Wheeler, whether she'd be prepared to extend that to a motion to the upcoming Local Government New South Wales conference, then to ask the General Manager whether it is now too late to lodge such a motion to the Local Government New South Wales conference, and then through you, Madam Mayor, to our representative director on Local Government New South Wales whether he's aware of any initiative in this area to make the formula more equitable. Through you, Madam Mayor, it is not too late to lodge a motion, and we can certainly review the proposed wording of a motion against the criteria set by LGNSW. One development is that the Local Government Grants Commission are proposing changes to the formula. They've written to councils today and seeking feedback. We're in the process of digesting that and preparing a memo to circulate to councillors. So if I could suggest through you, Madam Mayor, that we perhaps hold fire until we understand more fully the intentions of the Local Grants Commission in how they propose to modify the formula, and then we can go from there.

Thank you. Just to give you an update, the Local Government New South Wales Board, we recently discussed the FAG grants and the 1% because we felt like there wasn't, we'd sort of lost momentum. But from the discussion that I had with the President, Dasi Byrne, and the CEO, David Reynolds, is that the Local Government New South Wales, this is not something that they have put on the back burner. It is still very much a live issue. And I understand when the President went down and met with the Prime Minister, this was pretty much the number one topic that was discussed, from my understanding. So Local Government New South Wales is continuing to try and press every sort of lever they can to get the federal government to reinstate the 1%.

So, because this goes back from motions in previous government conferences, so it is something that is still well and truly alive on the board's agenda . Did

They have any discussion around what the things Councillor Wheeler had raised? I suppose they're not looking at individual. No

So Local Government New South Wales, I mean, they're looking at all sorts of different aspects, but the main thing is to try and get the funding back up to 1%. That was the core aspect of the motion that was put up. And I think trying to get them to even come to the table to discuss that has been difficult, but they're slowly making progress from what I understand. So when it comes to individual funding arrangements and all of that, it's not quite—they're trying to get the 1%. That's their main focus from what I understand. Thank you.

My only concern is that it would be too late to leave this to the October meeting, and I'd suggest that Councillor Wheeler's form of words to encourage us to consider— A form of words for a motion. Just very briefly, it appears that Local Government New South Wales must have had their ears burning while we were discussing this earlier today, so I'm very pleased that they're coming up with a new formula. I think it's—I know that there's a big push on at the moment for financial assistance grants to come up to the 1% previously promised, and I know the federal government, the minister at ALGA this year stated that they would not be doing that, that they had no intention of doing that. So there's going to have to be significant, a significant push, I think, from the member organisations to get them to reconsider that prior to the federal election. But I think we're at least in a space where we can do some lobbying in the lead-up to both state and federal elections, and we should. But I await with interest the new formula.

Councillor Wheeler. Thanks, Madam Mayor. Just, I'll start with 11.1.1 regarding ICAC recommendations. Could the same reports that are given to the ARIC also be provided to councillors, please, regarding those ICAC recommendations? I think we will all be waiting with interest to see what comes out of the recommendations from Operation Rosny. I'm struggling to get anything done because I'm glued to the broadcast . And of course, Hawkesbury Council has been to ICAC previously during Operation Spicer, as we are all well aware. 14.1.1. How do we then, it appears that we can get heritage of Western Sydney promoted through the VIC. How do we actually do that?

So the response, so I asked about this app that Council paid into and that still exists. I guess I hope when I raise something in questions on notice that something happens. You know, when I suggest there's a couple of items here where I've suggested that things would be good to happen, and it just comes back and says, yes, that could happen. And what I'd really like is for something to happen. Otherwise, if that isn't going to be the way it goes, then you're going to need to give me a pathway to follow in order to make that happen. I guess that's what I'm asking for, what that pathway is beyond me raising it and hoping for the best.

Just regarding the response to the Horsby Showground when it came to the Winterfest, we have got plans when the lease is up for small and medium-sized events, because clearly it wasn't acceptable. I don't know what you call Winterfest. What is it? It's not small. I wouldn't call it medium. I would call it large. I would call it large too. So I think the response to somebody said, Oh, well, we don't have to because we don't believe it's a large-scale event. Well, I would beg to differ, but I know you've got some resolution there. My comment to that is tough. Sort it out and stop mucking around with the local traffic laws, because it's getting worse. And clearly when you have these events, it should be on par with what the show does, which is an excellent traffic plan, dare I say.

Two, Council approve the making of application to the Minister for Local Government for the issue of a proposed acquisition notice, or a PAN, under the Land Acquisition (Just Terms Compensation) Act 1991 with respect to the acquisition of land.

Three, Council approve the making of application to the Governor for the publication of acquisition notice in the New South Wales Government Gazette under the Land Acquisition (Just Terms Compensation) Act 1991 with respect to the acquisition of the land. Four, Council bear all costs in association with the process of acquiring the parcel of land. Five, authority be given for the section 30 agreement, Land Acquisition Just Terms Compensation Act 1991, for the acquisition of part 46 Ogden Road, Oakville, and any documentation in association with this matter to be executed under the seal of Council. With respect to 15.3.2, as I was saying, moved on the motion of the Mayor, given it was on block, that Council, resolved, I should say, that Council, one, Council agree to the creation of an easement to the benefit of 10 George Road, Wilberforce, comprising an area of 31.37 square metres within Wilberforce Shopping Centre, 15 King Road, Wilberforce, lot D in Deposited Plan 334004, as outlined in this report and as shown in Attachment 2 to this report, and compensation in the amount detailed in this report be accepted by Council.

Two, the owners of 10 George Road, Wilberforce, reimburse Council for all legal costs incurred by Council in relation to the easement. Three, authority be given for any plans and other documentation in association with this matter be executed under the seal of Council. And four, details of the resolution be conveyed to the owners of 10 George Road, Wilberforce, together with the advice that Council is not and will not be bound by the terms of its resolution until such time as appropriate documentation to put such resolution into effect has been agreed to and executed by all parties. That was resolved unanimously with Councillor Dogramaci absent from the vote.
